Company, licence and merchant details](#sec-22-company-licence-and-merchant-details) **Please read these Terms carefully before using the GOCYC platform.** They form a binding contract between you and GO CYC SPORTS SERVICES. By accessing or using the Platform, creating an account, making a booking, registering for an event, or purchasing a product, you agree to be bound by them. If you do not agree, do not use the Platform. ## 1. About us The Platform is operated by **GO CYC SPORTS SERVICES**, a business licensed in the Emirate of Abu Dhabi, United Arab Emirates. GOCYC operates an integrated cycling platform covering bicycle rentals, event discovery and registration, bookable services, retail products, community cycling programmes, and partnerships with clubs, organisers and institutional bodies across the UAE. Our full registration, licensing, payment and merchant details are set out in **Section 22**. Our Privacy Policy, which explains how we handle personal data, is available in the app and on our website and forms part of these Terms. ## 2. Definitions **“GOCYC”**, **“we”**, **“us”**, **“our”** — GO CYC SPORTS SERVICES. **“Platform”** — the GOCYC mobile application, the GOCYC website, and any other digital interface through which GOCYC provides its services. **“User”**, **“you”**, **“your”** — any person or entity that accesses or uses the Platform. **“Account”** — the profile you create on the Platform. **“Content”** — any text, image, review, rating, listing or other material published on the Platform. **“Event Organiser”** — any individual or organisation that lists, organises or delivers a cycling event, ride or programme through the Platform. **“Service Provider”** — any third party offering bookable services through the Platform, including mobile maintenance and repair. **“Seller”** — any third party that lists products on the Platform for sale through its own channels. **“Products”** — physical goods sold by GOCYC as seller of record through the Platform. **“Rental”** — the hire of a bicycle, e-bike or accessory from GOCYC through the Platform. **“Rental Equipment”** — the bicycle, e-bike or accessory that is the subject of a Rental. **“Payment Gateway”** — the licensed third-party payment service used to process payments on the Platform. ## 3. Our role GOCYC operates an integrated cycling platform. Our role differs by service, and it matters: **Service****Our role****Bicycle rentals****Principal.** GOCYC provides the Rental Equipment and contracts with you directly.**Products****Seller of record.** GOCYC sells the product to you and is responsible for it.**Events****Facilitator.** The Event Organiser is responsible for the event.**Bookable services****Facilitator.** The Service Provider is responsible for the work performed.**Third-party product listings****Listing host only.** The sale takes place on the Seller’s own website.**Community programmes and rides organised by GOCYC****Organiser**, subject to Section 9. Where we act as facilitator or listing host, we are not a party to the contract between you and the Event Organiser, Service Provider or Seller. ## 4. Eligibility and Accounts ### 4.1 Age You must be **18 or over** to open an Account, enter into a Rental, or make a purchase. A person under 18 may use the Platform, take part in an event or programme, or ride Rental Equipment only where a parent or legal guardian registers on their behalf, supervises their use, accepts these Terms on their behalf, and assumes full responsibility for their participation. In that case, all references in these Terms to your obligations apply to the parent or guardian. If GOCYC suffers loss as a result of a transaction entered into by a minor without the consent of a parent or guardian, we reserve the right to seek recovery from that parent or guardian. ### 4.2 Registration You must provide accurate, current and complete information when registering, and keep it up to date. Inaccurate or misleading information may result in suspension or termination of your Account. You may not use a username or display name that is offensive, hateful, racist, defamatory, ethnically offensive, obscene, vulgar, sexually explicit, or that impersonates another person or organisation. ### 4.3 Business accounts Event Organisers, Service Providers, Sellers and corporate partners must provide valid trade licence details and any other credentials we reasonably require, and must maintain all licences and approvals necessary for their activity in the UAE. ### 4.4 Account security Your Account is personal to you. You are responsible for keeping your credentials confidential and for all activity that occurs under your Account. Notify us immediately at [support@gocyc.ae](mailto:support@gocyc.ae) if you suspect unauthorised access. We may refuse a requested username, suspend or terminate an Account, refuse service, or cancel an order or booking, at our reasonable discretion, in accordance with Section 16. ## 5. Payments, VAT and invoices ### 5.1 Prices and VAT **All prices displayed on the Platform are in UAE Dirhams (AED) and are inclusive of VAT** at the applicable rate. The total price payable, including any delivery charge, is shown to you before you confirm your order or booking. ### 5.2 Tax invoices A **tax invoice is generated and made available to you in the app** for every payment you make on the Platform, in the form required by the UAE Federal Tax Authority. You may view and download your invoices at any time from your Account. If you need assistance with an invoice, contact us directly at [support@gocyc.ae](mailto:support@gocyc.ae). ### 5.3 Payment Payment is taken through the Payment Gateway at the time of booking or purchase. We accept Visa and Mastercard credit and debit cards. GOCYC does not store your full card details. If you use a card issued outside the UAE, your bank may apply international transaction fees and its own exchange rate. GOCYC is not responsible for charges applied by your bank. ### 5.4 Authorisations and deposits For Rentals, we may place a **pre-authorisation or security hold** on your card. The amount is shown to you before you confirm the Rental. It is released after the Rental Equipment is returned in acceptable condition, less any amount properly deducted under Section 6. ### 5.5 Refunds Where a refund is due, it is processed to the original payment method. Refunds are issued by us promptly, and in any event within the period required by applicable UAE law. The time taken for funds to appear in your account depends on your bank or card issuer, and GOCYC is not responsible for that delay or for any fee your bank applies. ## 6. Bicycle Rentals ### 6.1 Booking Rentals are booked through the Platform and paid for in advance. By confirming a Rental you agree to this Section 6. ### 6.2 Your responsibilities You must: - be 18 or over, or be accompanied and supervised by a parent or guardian who has accepted these Terms; - be physically capable of riding the Rental Equipment safely; - **wear a correctly fitted helmet at all times while riding**; - inspect the Rental Equipment at hand-over and raise any concern before you ride; - comply with all UAE traffic laws and with the rules of any track, path or facility you ride on; - not ride under the influence of alcohol, drugs or any substance that impairs your ability to ride; - not carry passengers, use the Rental Equipment for racing, stunts, off-road or competitive use unless expressly agreed, or use it for any commercial purpose or sub-hire; - not permit any other person to ride the Rental Equipment; - keep the Rental Equipment secured when unattended, using the lock provided where one is supplied; - return the Rental Equipment to the agreed location by the agreed time, in the condition it was provided, allowing for fair wear and tear. ### 6.3 Condition records We record the condition of the Rental Equipment at hand-over and on return, including photographs. These records are used to assess any damage claim. ### 6.4 Damage You are responsible for the Rental Equipment for the duration of the Rental. Where the Rental Equipment is damaged beyond fair wear and tear, you are liable for the **reasonable cost of repair, up to a maximum of AED 15,000 per bicycle**, supported by a repair assessment which we will provide to you. ### 6.5 Loss and theft Where the Rental Equipment is lost, stolen or damaged beyond economic repair, you are liable for its **declared replacement value**, which is shown to you at the time of booking, **up to a maximum of AED 30,000 per bicycle**. Your liability under this clause is reduced where the loss or theft results from a cause outside your control, provided you complied with Section 6.2, secured the Rental Equipment as instructed, reported the incident to us within 24 hours, and filed a police report where one is required. We will apply this clause reasonably and on the facts of each case. ### 6.6 Late return Rental Equipment must be returned by the agreed time. Late returns are charged at **the applicable daily rental rate for that item plus AED 150 per bicycle per day, or part day**, up to the declared replacement value of the item. If the Rental Equipment is not returned and we are unable to contact you within **72 hours** of the agreed return time, we may treat it as lost under Section 6.5 and report it to the authorities. ### 6.7 Cancellation Cancellations made **at least 24 hours before the scheduled Rental start time** receive a full refund. Cancellations made within 24 hours of the start time are not refundable. If we cancel a Rental — for example due to equipment unavailability, weather or a safety concern — you receive a full refund or a rebooking, at your choice. ### 6.8 Incidents Report any accident, injury, damage, loss or theft to us immediately, and in any event within **24 hours**. Failure to report promptly may affect the assessment of liability. ## 7. Events and Programmes ### 7.1 Registration You may discover and register for cycling events, rides and programmes through the Platform. GOCYC acts as facilitator. The **Event Organiser is responsible** for the organisation, delivery, safety arrangements, timing, results and conduct of the event. ### 7.2 Event terms **Each event sets its own cancellation and refund period, which is clearly stated on that event’s page before you register.** Those terms apply to your registration, in addition to these Terms. Read them before you register. Where an event is cancelled or materially changed by the Organiser, the Organiser’s refund terms apply. GOCYC will pass on and support any refund the Organiser authorises, but we do not underwrite refunds on behalf of third-party Organisers. ### 7.3 Your data Registration data is shared with the Event Organiser as described in our Privacy Policy. Where an event or programme is delivered with, hosted by, or supported by a government or institutional partner, participation data may be shared with that partner; this is stated on the registration page for that event. ### 7.4 Images Events, rides and programmes may be photographed or filmed for reporting and promotional purposes. Where a specific event applies its own image policy or offers an opt-out, that is stated on the event page. Bookable Services ### 8.1 Booking and payment You may book maintenance, repair and other services from third-party Service Providers through the Platform. Bookings are paid in advance. ### 8.2 Our role GOCYC facilitates the booking. **The Service Provider performs the work and is responsible for its quality, safety and workmanship.** Any issue with the work should be raised with the Service Provider, and reported to us at [support@gocyc.ae](mailto:support@gocyc.ae) so that we can assist and, where appropriate, act on it in our relationship with that provider. ### 8.3 Cancellation Cancellations made at least **24 hours** before the scheduled service slot receive a full refund. Cancellations made after that point are not refundable. ## 9. Rides, Events and Assumption of Risk **Read this section carefully. It concerns your safety.** ### 9.1 Cycling carries inherent risk Cycling — on roads, tracks, paths and in groups — carries inherent risks that cannot be eliminated. These include collision with vehicles, other riders, pedestrians, animals or fixed objects; falls; mechanical failure; road, track and surface conditions; weather, heat and dehydration; and the actions or inexperience of other participants. ### 9.2 You ride at your own risk By taking part in any ride, event or programme organised or facilitated by GOCYC, and by hiring Rental Equipment, **you acknowledge and accept these risks and participate voluntarily and at your own risk.** ### 9.3 Fitness and medical condition You confirm that you are in good health and physically fit to take part, and that you are not aware of any medical condition that would make participation unsafe for you or for others. **If you have any doubt, consult a doctor before taking part.** You are responsible for managing your own medical conditions, medication, hydration and nutrition during any activity. ### 9.4 Insurance **GOCYC does not provide personal accident, medical, travel, liability or equipment insurance to participants.** You are responsible for arranging any insurance you consider appropriate, including personal accident and medical cover, and cover for your own bicycle and equipment. ### 9.5 Safety obligations While taking part you must: - wear a correctly fitted helmet at all times; - comply with UAE traffic law and the rules of the road, track or facility; - use lights and reflective equipment where riding in low light; - ride within your ability and follow the instructions of ride leaders, marshals and organisers; - ride in a manner that is safe for you and for those around you; - not participate under the influence of alcohol or any impairing substance; - carry a working means of communication and your emergency contact details. We may refuse participation to, or remove from an activity, any person who is unfit to ride, whose equipment is unsafe, or whose conduct puts themselves or others at risk. No refund is due in those circumstances. ### 9.6 Your own equipment If you take part using your own bicycle and equipment, you are responsible for its condition, roadworthiness and suitability. GOCYC does not inspect, certify or accept responsibility for equipment we did not supply. ### 9.7 Minors A participant under 18 must be registered by, and remain the responsibility of, a parent or legal guardian, who accepts this Section 9 on their behalf. Where a programme requires it, the guardian must be present or contactable throughout. ### 9.8 Emergency contact You must maintain a current emergency contact number in your profile. You authorise us to contact that person in the event of an incident. ### 9.9 What this section does not do **Nothing in this Section 9, or anywhere else in these Terms, excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under the laws of the United Arab Emirates.** ## 10. Products sold by GOCYC ### 10.1 Seller of record GOCYC is the **seller of record** for Products purchased through the Platform and is responsible for those Products. ### 10.2 Product information Product images are illustrative. Read the product description for accurate specification and detail. We make reasonable efforts to keep stock and pricing accurate, but errors can occur. If a Product you have ordered is unavailable, we will contact you and either offer an equivalent alternative or cancel that item and refund it in full. If we cannot reach you, we will fulfil the remainder of your order and refund the unavailable item. ### 10.3 Your right to return **You may return a Product within 14 days of receiving it, for any reason, for a full refund**, provided it is unused, in its original condition and packaging, and complete with all accessories and documentation. Contact us at [support@gocyc.ae](mailto:support@gocyc.ae) to arrange a return. This right does not apply to Products that are personalised or made to your specification, Products that by their nature cannot be returned once unsealed for reasons of hygiene, or consumables where the seal has been broken. Any such exclusion is stated on the product page before you purchase. Refunds are issued to your original payment method within **14 days** of our receiving the returned Product. ### 10.4 Faulty Products Where a Product is faulty, defective, or does not match its description, you are entitled to a repair, replacement or refund in accordance with UAE consumer protection law. This right is in addition to, and unaffected by, Section 10.3, and applies for the applicable statutory period. Manufacturer warranties apply in addition and vary by brand; warranty terms are provided with the Product. ### 10.5 Delivery and title Delivery timescales and charges are shown before you confirm your order. Where a delivery address is outside the UAE, you are responsible for any import duty, tax and customs clearance charge. Title to a Product passes to you only once payment has been received in full. ## 11. Third-party product listings Sellers may list products on the Platform. **These listings are hosted, not sold, by GOCYC.** - We review listings before they are published, to check that they are appropriate for the Platform. That review is a moderation check only. It is **not** an inspection, endorsement, valuation, authentication or warranty of the product, its condition, its legality, or the Seller. - Selecting a listing directs you to the **Seller’s own website**, where the sale is concluded. Your contract is with the Seller. - The Seller’s own terms, pricing, payment, delivery, warranty, return and refund policies apply, and their privacy policy governs any data you provide to them. - GOCYC takes no payment and no commission on those sales, and is not a party to them. - We accept no responsibility for the product, its description, its condition, its delivery, or any dispute arising from the sale. Raise any issue directly with the Seller. **Sellers** are responsible for the accuracy and legality of their listings, must hold all licences required to sell in the UAE, must keep listings current, and must remove listings for items no longer available. We may remove any listing at our discretion and without notice, and may suspend a Seller who breaches these Terms. ## 12. User Content and conduct ### 12.1 Acceptable use You agree to use the Platform only for lawful purposes. You must not: - access the Platform by automated means, including scripts, scrapers or crawlers; - disrupt or interfere with the Platform or the servers and networks connected to it; - attempt to gain unauthorised access to any part of the Platform or any other user’s Account; - copy, reproduce, resell, redistribute or commercially exploit the Platform or its content; - post Content that is unlawful, offensive, indecent, hateful, defamatory, misleading, or that infringes the rights of others; - impersonate any person or organisation, or misrepresent your affiliation with one; - use the Platform to send unsolicited commercial communications. ### 12.2 User Content You are responsible for Content you post. You confirm you have the right to post it. We may refuse, edit or remove any Content, but we are not obliged to review Content and are not liable for Content posted by users. By posting Content, you grant GOCYC a **non-exclusive, royalty-free, worldwide licence** to use, reproduce, display and adapt that Content in connection with the Platform and the promotion of GOCYC. You retain ownership of your Content. ### 12.3 Reviews Reviews and ratings must be honest and based on genuine experience. We may remove reviews that are false, abusive, or posted to manipulate a rating. ## 13. Liability ### 13.1 What we are responsible for We are responsible for loss you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. ### 13.2 What we are not responsible for To the fullest extent permitted by UAE law, GOCYC is not liable for: - indirect, incidental or consequential loss; - loss of profit, revenue, business, contracts, anticipated savings, data or goodwill; - loss arising from the acts, omissions, performance or conduct of an Event Organiser, Service Provider or Seller; - loss arising from a transaction concluded on a Seller’s own website; - loss arising from your failure to comply with Section 6 or Section 9; - loss arising from your own equipment, or from your medical condition or fitness to participate; - loss arising from events outside our reasonable control (Section 15). ### 13.3 Cap Where we are liable, our total liability arising out of or in connection with a Rental, booking, registration or order is limited to **the total amount you paid to GOCYC for that Rental, booking, registration or order.** ### 13.4 What is never excluded **Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded or limited under the laws of the United Arab Emirates.** Nothing in these Terms excludes or limits your statutory rights as a consumer under UAE law. ## 14. Indemnity You agree to indemnify and hold GOCYC harmless against any claim, loss, damage, cost or expense arising from your breach of these Terms, your misuse of the Platform, your use of Rental Equipment, or your participation in any ride, event or programme, except to the extent caused by our own negligence or breach. ## 15. Force majeure Neither party is liable for failure or delay in performance caused by an event outside its reasonable control, including act of God, extreme weather, sandstorm, flood, fire, epidemic, failure of power or telecommunications, industrial action, act or omission of government, closure of roads or facilities, war, civil unrest, or act of terrorism. Where such an event prevents a Rental, booking or event from proceeding, we will offer a rebooking or a refund. ## 16. Suspension and termination **By us.** We may suspend or terminate your Account, or refuse or cancel a booking or order, where you breach these Terms, where we reasonably suspect fraud or unlawful use, where you fail to pay, or where your conduct puts the safety of others at risk. Where practicable we will tell you why and give you an opportunity to respond. **By you.** You may close your Account at any time in the app or by contacting [support@gocyc.ae](mailto:support@gocyc.ae). **Effect.** On termination, your right to use the Platform ceases. Termination does not affect accrued rights or obligations, including outstanding payments, liability for Rental Equipment, and any provision intended to survive termination — including Sections 9, 13, 14 and 19. ## 17. Intellectual property All content, logos, trademarks, design, software and materials on the Platform are owned by GOCYC or its licensors and are protected by intellectual property law. You may access and use the Platform for personal, non-commercial purposes only. You may not copy, broadcast, download, store, transmit, publicly display, adapt or modify any part of the Platform without our prior written permission. ## 18. Third-party links The Platform contains links to third-party websites and services, including Seller websites and Event Organiser pages. We do not control them, do not endorse them, and are not responsible for their content, practices, terms or privacy policies. Review their terms before using them. ## 19. Changes to these Terms We may modify these Terms. The revised version governs your future use of the Platform, and each version is dated and numbered. Changes do not apply retrospectively to Rentals, bookings, registrations or orders already confirmed. Where a change is material, we will give notice in the app or by email before it takes effect. If you do not accept a revised version, stop using the Platform and close your Account. Continued use after the effective date constitutes acceptance. ## 20. General **Entire agreement.** These Terms, together with the Privacy Policy and any terms specific to an event, Rental or product, form the entire agreement between you and GOCYC. **Severability.** If any provision is held invalid or unenforceable, the remaining provisions continue in full force. **No waiver.** A failure to enforce any provision is not a waiver of the right to enforce it later. **Assignment.** You may not assign your rights under these Terms. We may assign ours in connection with a merger, acquisition or transfer of business, without reducing your rights. **Language.** These Terms are issued in English, which is the governing language. ## 21. Governing law and jurisdiction These Terms, and any dispute or claim arising out of or in connection with them, the Platform, or any purchase, booking or Rental made through it, are governed by and construed in accordance with the **laws of the United Arab Emirates**. You agree to submit to the jurisdiction of the **courts of the Emirate of Abu Dhabi**. Nothing in this Section affects your right to raise a consumer complaint with the competent authority in the UAE, including the Department of Economic Development or the Ministry of Economy. ## 22.
